Terms of Service

These Terms are an agreement between you and Birdies and Alibis LLC, a Utah limited liability company (“Birdies & Alibis,” “we,” “us,” or “our”). By creating an account, administering a league or tournament, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you act for an organization, you represent that you have authority to bind it.

1. Eligibility and accounts

You must be at least 16 to create and independently use an account. A golfer under 16 may participate without an account when managed by an authorized adult organizer, parent, or guardian. Users under 18 must have permission where required. You must provide accurate information, safeguard credentials and private links, and promptly report unauthorized access.

2. The Service

Birdies & Alibis provides golf league, tournament, course, and group tools, including scheduling, registration, scoring, standings, communications, payments, and operations. Features depend on plan, configuration, device, administrator choices, and third-party availability. The Service is not the USGA or GHIN, and we do not guarantee a score will be posted to GHIN or accepted for handicap purposes.

3. Organizer responsibilities

League and tournament organizers are responsible for their authority to collect and use participant information; event, price, prize, handicap, eligibility, refund, and safety information; permits, rules, accommodations, fulfillment, taxes, disputes, and refunds; administrator permissions; moderation; and the accuracy of external-payment records. Organizers must not use the Service for unlawful, unsafe, discriminatory, misleading, or fraudulent activity.

4. Payments

Stripe processes paid platform plans and tournament platform fees. Tournament organizers may connect their own Stripe account to accept participant payments and are also bound by Stripe’s applicable agreements. Platform charges are governed by our Billing, Cancellation & Refund Policy. Participant entry fees and organizer refund terms are separate. Birdies & Alibis does not hold wagers, run gambling games, or hold prize pools; skins, winnings, and external payments are scoring and recordkeeping tools only.

5. User content

You retain ownership of content you submit. You grant us a nonexclusive, worldwide, royalty-free license to host, process, reproduce, display, transmit, and modify it only as reasonably necessary to operate, secure, support, and improve the Service and comply with law. You represent that you have the rights and authority to submit it.

You may not submit unlawful, infringing, abusive, threatening, deceptive, malicious, or privacy-invasive content. We and authorized administrators may remove content or restrict access to protect users, enforce these Terms, or comply with law. Report content concerns to admin@birdiesandalibis.com.

6. Acceptable use

You may not probe or bypass security; access another account or organization without authority; misuse credentials, guest links, personal data, or payment information; scrape or overload the Service; introduce malware; reverse engineer except where law permits; manipulate scores or payments fraudulently; or violate law or another person’s rights.

7. Third-party services

The Service relies on Google/Firebase/Google Cloud, Stripe, Gmail, Google Cloud Vision, and OpenGolfAPI. Third-party terms and availability may apply. Course data and OCR results may be incomplete or inaccurate and must be reviewed. We are not responsible for organizer-selected external payment services such as cash or Venmo.

8. Suspension and termination

We may suspend or terminate access for nonpayment, security risk, unlawful use, material breach, or harm. Failed recurring payments may receive the grace described in the Billing Policy. Voluntary cancellation leaves access through the paid period but does not erase data or accrued obligations. You may request account deletion subject to lawful retention exceptions.

9. Availability and disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE UNINTERRUPTED OR ERROR-FREE OPERATION, A SERVICE LEVEL, ERROR-FREE OCR OR COURSE DATA, ACCURATE USER-ENTERED SCORES OR PAYMENT STATUS, EVENT SAFETY, OR A PARTICULAR RESULT. NONWAIVABLE CONSUMER RIGHTS REMAIN UNAFFECTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRDIES & ALIBIS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, USE, OR DATA. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE DIRECT FEES YOU PAID TO BIRDIES & ALIBIS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS CAP DOES NOT MAKE US RESPONSIBLE FOR ORGANIZER-COLLECTED FUNDS, PRIZES, WAGERS, EXTERNAL PAYMENTS, OR CONNECTED-ACCOUNT BALANCES. LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

11. Organizer indemnity

If you use the Service as an organizer, administrator, course, club, business, or connected-account holder, you will defend, indemnify, and hold harmless Birdies & Alibis and its personnel from third-party claims, losses, and reasonable costs arising from your event, participant information, content, pricing, payments, prizes, taxes, refunds, legal violations, or breach of these Terms, except to the extent caused by our own unlawful conduct. This section does not apply to an ordinary golfer solely because they participate in a league or tournament.

12. Disputes and governing law

Before filing a claim, send written notice to the contact below and allow 30 days for an informal resolution. Either party may use an eligible small-claims court. Utah law governs these Terms without regard to conflict-of-law rules, and other claims must be brought in state or federal courts located in Salt Lake County, Utah, unless applicable law requires otherwise. These Terms do not require arbitration or waive class-action rights.

13. Changes

We may update these Terms. We will post a new version and effective date and provide additional notice or request renewed acceptance when required.
